Mandatory DPT-3 Filing for FY 2023-24 Due by June 30, 2024: Essential Compliance to Avoid Penalties

As per Rule 16 the Companies (Acceptance of Deposits) Rules, 2014, every company shall on or before the 30th day of June, of every year, file with the concerned Registrar of Companies, a return in e-Form DPT-3 for deposits and/or particulars of transaction not considered as deposit as on the 31st day of March of that year. It is to be noted that DPT-3 filing is mandatory for all the exempted deposits as given under Rule 2(1)(c) the Companies (Acceptance of Deposits) Rules, 2014. Thus, the company must ensure that, if it has received any deposits and/or exempted deposits during the financial year, it must complete the filing on or before the due date. Accordingly, the due date of DPT-3 filing for the financial year 2023-24 is June 30, 2024.

Form DPT-3 filing is an essential compliance requirement for companies in accordance with the Companies (Acceptance of Deposits) Rules, 2014. Understanding the applicability, deadlines, and consequences associated with Form DPT-3 is crucial to avoid penalties and maintain regulatory compliance. With its applicability to all companies, filing frequency, reporting details, consequences of non-compliance, and exempted transactions, it serves as an essential compliance tool. The form requires companies to provide comprehensive information about their outstanding loans, deposits including exempted deposits, and other specified transactions as of the date of the balance sheet.

If the company contravenes any provision of these rules for which no punishment is provided in the Act, the Company and every officer of the company who is in default shall be punishable with fine which may extend to five thousand rupees and where the contravention is a continuing one, with a further fine which may extend to five hundred rupees for every day after the first day during which the contravention continues along with additional fees as mentioned in Companies (Registrar of offices and Fees), Rules, 2014.
