The Ministry of Labour and Employment Extends ESI Act Provisions to Several Districts in Manipur

The Ministry of Labour and Employment (“Labour Department”) has issued a notification regarding the implementation of various provisions of the Employees’ State Insurance Act, 1948 (“ESI Act”) in several districts of Manipur. The notification bearing number S.O. 2696(E) specifies that the provisions of specific sections of the ESI Act will be implemented in the districts of Bishnupur, Senapati, Ukhrul, Kangpokpi, Churachandpur, and Thoubal in the state of Manipur, effective from August 01, 2024.

Sections Extended

The notification brings into force the provisions of the following sections of the ESI Act in the above-mentioned districts of Manipur:

  • Sections 38 to 43: These sections mandate the contribution to the Employees' State Insurance fund by both employers and employees. They outline the rates of contribution and the process of payment, ensuring that every employee covered under the ESI Act is insured against various health-related risks.
  • Sections 45A to 45I: These sections address the determination of contributions in specific instances, the right to appeal to the appellate authority, the recovery of contributions, the issuance of certificates to recovery officers, the stay of proceedings under such certificates, and the amendment or withdrawal of certificates. Additionally, they cover other methods of recovery.
  • Sections 46 to 73: These sections primarily provide a comprehensive list of benefits available under the ESI Act and their related provisions, including, but not limited to, medical benefits, sickness benefits, maternity benefits, disablement benefits, dependents’ benefits, and other benefits such as funeral expenses.
  • Section 74 and Section 75: These sections pertain to the establishment and function of the Employees' Insurance Court, which adjudicates disputes related to the payment of benefits, recovery of contributions, and other matters pertaining to the ESI Act.
  • Sub-sections (2) to (4) of Section 76: These sub-sections outline the procedures for filing and handling disputes and claims in the Employees' Insurance Court, ensuring a fair and efficient resolution process.
  • Section 82 and Section 83: These sections detail the appellate process and the finality of orders. They provide the framework for appealing decisions made by the Employees' Insurance Court, thereby ensuring that justice is accessible and that decisions are conclusive.

Implications

The enforcement of these provisions will extend the reach of the ESI Act to workers in the specified districts of Manipur, ensuring they receive the comprehensive social security benefits covered under the ESI Act. This includes access to medical care, cash benefits during sickness and maternity, monthly payments in case of disablement, and various other welfare measures aimed at improving the well-being of employees and their dependents.
