Introduction Of Web-Based Services For Filing Of DIR-3 KYC

• The Ministry of Corporate Affairs (MCA) recently on 25th July 2019 issued the Companies (Appointment and Qualification of Directors) Third Amendment Rules, 2019. As per the amended rules the MCA introduced web – based services for filing of the DIR-3-KYC-WEB on the MCA portal. The key-points introduced as per the amended rules are as follows:


• The web-based form DIR-3-KYC-WEB shall be filed by DIN holders who had already submitted the DIR-3 KYC in the previous financial year and do not wish to update their details on the portal.


• The e-Form DIR-3 KYC is required to be filed, by all the DIN holders, in case where the DIN has been allotted from the period starting from 1st April 2018 to 31st March 2019 and who are filing their KYC details for the first time.


• The DIN holders who have already filed the e-form DIR-3 KYC and wish to update their details such as change in their registered mobile number and registered email address are also required to file the e-form DIR-3 KYC again for the current financial year i.e. FY 2019-20.


• In case any DIN holder desires to update any other personal detail except his/her mobile no. or email address, they are required to file e-form DIR-6 for updating such other details before completion of DIR-3-KYC-WEB through the web-based service on the MCA portal.


• The aforementioned forms have been enabled on the MCA portal and the last date of submission of e-form DIR-3-KYC and DIR-3-KYC-WEB, as the case may be, with the Registrar of Companies (ROC) is 30th September 2019. The filings can be done on or before the due date i.e. 30th September 2019, without submission of any fees.


• In the event the e-Form DIR-3 KYC or web service DIR-3-KYC-WEB are not filed on or before the due date, then the same will attract a penalty of INR 5000/- for late filing of the aforesaid requisite forms on the MCA Portal as the case may be.
